Ebute Meta Chief Magistrate Court

A man, whose daughter was allegedly raped by a 45-year-old man, has told an Ebute Meta Chief Magistrate’s Court that the suspect should be allowed to go.
He said a medical test conducted on the victim had revealed she was not infected with any disease, adding that he had discovered that the suspect had a mental problem.

He said, “I don’t want to have any case with him. He has a mental problem. A medical test has shown that my daughter is okay. I am not interested in pursuing any case against him.”
The police had arraigned the suspect, Oyetiola Olatunju, a cart pusher, before the court for allegedly raping the 14-year-old victim at the Agbado, Oke-Odo, Ile-Epo area of Lagos.
He had been arraigned on two counts of rape.
The charge read, “That you, Oyetiola Olatunju, on July 3, 2014, at Yusuf Yekini Street, Agbado, Oke-Odo, Ile-Epo, Lagos, in the Lagos Magisterial District, did unlawfully caused a 14-year-old girl to engage in sexual activities with you without her consent.
“That you did unlawfully have sexual intercourse with a 14-year-old girl.”
The police prosecutor, ASP Etim Nkankuk, had said the offence was punishable under Section 264 and 137 of the Criminal Law of Lagos State, Nigeria, 2011.
The police prosecutor asked the court to adjourn for legal advice from the Directorate of Public Prosecutions.
The Chief Magistrate, O.O. Olatunji, who said the offence was bailable, admitted the defendant to bail in the sum of N300, 000 with two sureties in like sum.
The mater was adjourned till October 8, 2014 for legal advice.
